  • Negotiate and draft patent license agreements .
  • Prosecute trademark applications and represented clients before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office.
  • Successfully defend trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board.
  • Manage large U.S. and international trademark and patent portfolios for companies providing goods and services in the fields of alternative energy, nutritional supplements, real estate, tourism, and financial services.
  • Trademark, copyright and patent litigation in the state and federal courts.
  • Obtained a preliminary injunction in a trademark infringement matter resulting in the termination of all sales and advertising of infringing goods.
  • Obtained a temporary restraining order to prevent a consultant from using and disclosing client materials post-termination.
  • Successfully handled some of the earliest administrative (UDRP) and District Court proceedings involving domain name “cyber-squatting.”
  • Advise clients with respect to IP acquisition, due diligence, licensing, management and enforcement.
  • Negotiate and prepare technology transfer, licensing and other agreements and contracts regarding all aspects of IP rights and ownership.
  • Advise clients on issues relating to IP rights on the Internet.
  • Draft and advise clients on Website terms of use, privacy policies, framing, linking and online contents and promotions.
  • Prepare articles of organization and incorporation, operating agreements and bylaws, asset purchase agreements, buy-sell agreements and related corporate documents.
  • Represent employees in administrative appeal of reprimand and job reassignment.
  • Defend attorneys in malpractice actions.
  • Defend attorney in disciplinary proceedings before the State Bar of Arizona.
  • Negotiate emerging technology and infrastructure roll-out and testing agreements with various Fortune 100 companies.
  • Represented a major research institute in patent protection matters, including formulating patent strategies, filing provisional and utility patent applications and licensing, targeting Alzheimer’s disease, Parkinson’s disease and arthritis.
  • Represented the intellectual property development arm of a major hospital system in analysis of patentability of and commercial evaluation of internally developed medical devices, and preparation of provisional and utility patent applications with respect thereto.
  • Represented a state agency on patent strategies and commercial evaluation of disease control formulations and techniques, including patent prosecution of U.S. and international patents targeting molecular biochemical discoveries related to cancer prevention.
  • Represented a variety of clients in patenting mechanical, electrical and business method inventions.
  • Litigated patent infringement actions relating to laser opto-electronic devices, semiconductor manufacturing technologies, and circuit design.
  • Represented clients subjected to audit by Business Software Alliance and Software Publishers’ Association, and sued for infringement by a large computer software company.
  • Represented both plaintiffs and defendants in architectural copyright infringement cases involving apartment designs and single family home designs.
  • Represented golf course owner in state antitrust litigation alleging boycott and price fixing.
  • Represented medical device/biotechnology companies in respect to domestic and international patent matters, due diligence and other intellectual property issues.
  • Represented a variety of clients in patenting, electrical, optical and mechanical inventions.
  • Represented a variety of clients in providing infringement and validity opinions, due diligence, non disclosure agreements, business entity formation, and licensing strategies.
